Your personal data is only used to provide a service that you have requested; in the way described in this Policy; in a way that complies with legal obligations; your rights; in compliance with the General Data Protection Regulation (GDPR).

Passing You Driving School has been the business trading name and brand of Paul Goodman, providing professional driving tuition since 2014. 2. Use of cookies

Like many websites, this site also uses cookies. Cookies are small data files stored in your browser. The cookies on this site collect analytical (statistical) data (e.g. how many visits the website gets; what pages are visited; how long visitors spend on the pages, etc). Information data can include your device IP address (a unique device identifier); the analytical information does not identify you personally, it provides useful information such as the operating system used, device type, browser type, region or country. 3. Personal data

Personal data is controlled by a designated person who determines how data is processed (e.g. obtained, recorded, held, transferred, disclosed, blocked, erased). Passing You Driving School only uses data to provide a requested service and to maintain a viable business function.

Using this website will not identify you personally. However, if you wish to make an enquiry, some personal data will be required to provide a service to you. Failing to provide the following legitimate information will likely result in no services being offered or services being withdrawn: Your Name; Address; Date of birth; Driving licence detail (including disclosure of endorsements). In some cases for safety and insurance purposes a licence check code may be required to confirm your legitimate driving status, see https://www.gov.uk/view-driving-licence

5. Legitimate processing

In order for Passing You Driving School to conduct a viable business function information is collected to confirm your identity and legal driving status; to comply with driving insurance requirements; to hold a record of your agreement to service terms and conditions; for public safety and to prevent fraud.

6. What data is collected

Some or all of the following personal data may be collected or requested from you, depending on if you are making an enquiry or a client of the driving school. Some information is voluntary and some is required as a condition of service. Information collected may include: your name; current address; mobile number; email address; enquiry message; driving licence details; your date of birth; any voluntary disclosures of learning, medical or other driving support needs; in car cam voice recording; any other relevant information needed in providing a professional service in keeping with professional codes of practice.

The Data Controller (and/or Driving Instructor) receives your personal information and is responsible to safeguard any information you provide.

8. Data collection safeguards

Passing You Driving School is committed to keeping your personal data safe and protected. Safeguards are in place to make the collection, storage and transfer of personal data safe using high end encryption and access security where applicable.
a) This website uses an SSL Certificate which uses a minimum 256-bit encryption to reduce hacking (unlawful access to a device or network) and reading of data that is forwarded from this site. This can be evidenced by the padlock symbol in your browser bar and the ‘https’ before the domain name which shows that SSL encryption is in use.
b) Email correspondence and enquiries are held in a secure account mail box accessed by a single hard drive for a limited period. Emails are not kept unless ongoing communication is likely or needed. If a service cannot be provided, or a service has come to an end, supplied personal information is deleted.
c) The personal data provided by the client is kept with the instructor (who is also the Data Controller). Student files are not left in a vehicle overnight. The information is not shared beyond the instructor. Printing of information is avoided whenever possible, however where printing on paper is needed that includes personal information, once it has served it's purpose it is disposed of using high security cross shredding for waste disposal.
d) Text (SMS) messages are protected by the security measures of the mobile network over which the driving school has no control.
e) When dash cam video recording is used, it would be on a loop system and only records out-of-car video footage (not the driver), however in-car sounds (eg. voices, use of a signal indicator) can be picked up by the dash cam microphone. A sign is displayed on the car when recording is in operation for the purpose of accident insurance evidence support and security. Your privacy rights can be explained to you during your tuition.
f) A client's bank details are not required except when a refund of a remaining balance is requested. However, the bank details are not saved after completion of any bank transfer; any further transactions would require bank details to be provided again.
Your personal data will not be shared with any third parties for any purpose, except in limited circumstances, such as when it may be required to share data in order to meet a legal obligation or requirement to a governing authority, law enforcement service, or a criminal offence is suspected.

9. Retention periods

Personal data is retained only for as long as it is needed to provide the services you have requested and only for legitimate business or legal purposes. The following factors determine how long your personal data is kept:
a) When an email enquiry has been actioned, or the enquiry does not result in a service, the email will be deleted from the server.
b) When an email results in a service being offered to you (and accepted), the email may be deleted once it serves no further purpose, or if it is needed the email may be held until you cease to be a client.
c) Your personal information you agreed to provide on a Lessons Enquiry Form is kept until a service is no longer required, or is no longer offered.
d) SMS (text) messages are kept for an unspecified period of time, as your name in the contact list identifies who has sent a message and/or you may make a future enquiry should you return to driving after a break period; the school may also have a need to contact you for an update following a break period. Any contact details and messages can be deleted at your request at any time provided the school does not legitimately need to keep your details for legal reasons, or needs to identify the sender of unwanted communications.
e) A video sequence recorded on a dash cam will by default be erased and recorded over on a continued loop basis (unless the recording is needed as evidence in the event of an incident / accident).
f) With regards to student learning records, if after a period of 3 months the student has not taken any further driving lessons with this school, except for reasons of exceptional circumstances (e.g. Covid pandemic lockdown or a pre-arranged break agreed with the instructor), the student record file will be not be retained and will be shredded for privacy and security.

10. Your rights

If you wish to exercise any of your rights please contact the Data Controller. The GDPR provides the following rights for individuals: The right to be informed; The right of access; The right to rectification; The right to erasure; The right to restrict processing; The right to data portability; The right to object; Rights in relation to automated decision making and profiling. 11. Making a complaint

You have the right to complain to the Data controller if you are unhappy with how your Personal Data is processed. If you are still unhappy following the response from the Data Controller, you have the right to lodge a further compliant with the Information Commissioners Office (ICO) by contacting the Information Commissioner's Office, Wycliffe House, Water Lane, Wilmslow Cheshire SK9 5AF.

12. Accessing your data

If your personal information needs updating, is inaccurate or incomplete; you can request the relevant changes are made to your personal information. Please contact the Data Controller to update your personal information.

13. Information requests

If you want to know what personal data is held about you (this is generally information you have provided), you can make an email request to the Data Controller for details of what data is held and request a copy of it. The Data Controller will respond to your request normally within 2 working days.
